Terms of service

Last updated: 18 September 2026

1. Seller and scope

The store store.profumieradivenezia.it is operated by VAGANOVA IRINA, a sole proprietorship trading as La Profumiera di Venezia by Irina Vaganova. Registered office: Via Triestina 10/C, 30173 Venice (VE), Italy. Laboratory and returns address: Via Caneve 17, 30173 Venice (VE), Italy. VAT number: 04648030270; Italian tax code: VGNRNI81A69Z135O; REA registration: VE-442527. Email: info@profumieradivenezia.it. Telephone: +39 366 978 1845.

These terms govern use of the store and purchases of products and services. Each purchase is also subject to the information on the relevant product or service page and the terms communicated before the order is placed. A consumer is a person who purchases for purposes outside their trade, business or profession. The relevant rules apply to professional purchases; buying raw materials does not automatically make a customer a professional purchaser.

2. Customer accounts and information

To make a purchase, you must be legally able to enter into the contract and provide accurate information for payment, invoicing and delivery. If you use an account, keep your login credentials secure and notify us promptly of any unauthorised access. We ask only for information necessary to carry out the requested transactions. Do not send passwords or complete payment card details by email.

3. Products and pre-purchase information

Product and service pages describe the characteristics, quantities, formats and prices and, where applicable, the content, duration and delivery method of a service. Differences in how devices display colours do not affect our obligation to supply goods that conform to their description and the contract. Subsequent changes to product pages do not alter the characteristics agreed for orders already accepted.

Raw materials must be used in accordance with the applicable instructions, warnings and safety documentation. Educational content does not replace the checks required before placing a finished product on the market. These clarifications do not limit the seller's obligations concerning the products supplied.

4. Orders and formation of the contract

Before submitting your order, you can review the products, quantities, details and total amount. Submitting an order that carries an obligation to pay constitutes an offer to purchase. The contract is formed when we confirm our acceptance; a message merely acknowledging receipt of the request does not amount to acceptance unless its content expressly states otherwise.

If an item is unavailable, delivery is impossible, payment is not authorised or a material error occurs, we will contact you to clarify the situation. We will not substitute products or increase the price of an accepted order without your agreement. If an order is not accepted or is lawfully cancelled, we will refund the amounts received. Your statutory right of withdrawal and other legal remedies remain unaffected.

5. Prices and payment

The applicable prices and currency are those displayed when the order is placed. For consumers, the total including applicable taxes, shipping costs and any other charges imposed by the store is shown before payment. Available payment methods are displayed at checkout. No optional additional charges are made without an express choice.

For destinations subject to import procedures, any customs duties, taxes and clearance charges requested by the authorities or carrier depend on the destination. The applicable conditions are described in our Shipping Policy. Subsequent price changes do not apply to orders already accepted.

6. Shipping, delivery and risk

Shipping destinations, charges and delivery times are shown at checkout and in our Shipping Policy. For consumer purchases, unless a different delivery period has been agreed, delivery takes place without undue delay and in any event within thirty days of the contract being formed. If delivery does not take place, the additional period and the right to terminate the contract provided by law remain applicable.

For consumers, the risk of loss or damage passes when the goods are physically handed over to the consumer or to a third party designated by them, other than the carrier. The statutory exception concerns a carrier independently chosen by the consumer and not offered by the seller, in the circumstances provided by law. Handing a parcel to a carrier we offer does not automatically transfer the risk to the customer.

If a parcel is damaged, does not arrive or is returned to sender, contact us with your order number. Requests for photographs or prompt notification are intended to help us resolve the issue and do not remove statutory rights.

7. Withdrawal, returns and refunds

As a general rule, consumers have fourteen days to withdraw from distance purchases. The time limits, procedures, return costs and refund arrangements are described in our Refund Policy, which forms part of these terms. Exceptions apply only where provided by law: merely portioning a raw material or choosing a standard size does not automatically make a product personalised.

8. Statutory guarantee of conformity

Goods purchased by consumers are covered by the statutory guarantee of conformity under the Italian Consumer Code, generally for defects that become apparent within two years of delivery. In the circumstances and order provided by law, the consumer may request repair or replacement free of charge and, where the legal conditions are met, a price reduction or termination of the contract. Any commercial guarantee offered does not replace these rights.

Assessment of conformity also takes into account the nature of the goods, their stated characteristics, their reasonably expected durability and the conditions of storage and use. To report a defect, write to info@profumieradivenezia.it. The fourteen-day withdrawal period is not the deadline for asserting a lack of conformity.

9. Courses, workshops and digital content

The relevant service page describes the programme, format, dates, duration, requirements and what is included in the price. Any rescheduling or cancellation conditions must be communicated before purchase and cannot remove mandatory consumer rights.

For services purchased at a distance, the withdrawal period begins when the contract is concluded, unless an exception applies lawfully to the specific service. Starting performance during the withdrawal period requires the consumer's express request where prescribed by law. For digital content not supplied on a tangible medium, loss of the right of withdrawal requires the legal conditions to be met, including express consent to begin performance, acknowledgement of the loss of the right and contractual confirmation. Merely sending a link does not replace these requirements.

10. Shopify and third-party services

Shopify provides the technological platform for the store. The sales contract is concluded with VAGANOVA IRINA, not Shopify. Shopify does not assume the seller's obligations concerning our products, their delivery or refunds; each party remains responsible for its own obligations under applicable law.

Any external services may be subject to their own terms, provided by the relevant supplier. Using them to fulfil one of our orders does not exclude responsibilities imposed on us by law.

11. Content and use of the website

Text, images, trademarks and other materials are protected by the rights of their respective owners. You may use the website to obtain information and make purchases, including in the course of your professional activity. Downloadable materials are subject to the permissions and conditions stated in those materials; these terms do not revoke any sharing permission expressly granted.

Unlawful use, fraud, distribution of malware, unauthorised access and unauthorised collection of personal data are prohibited. Security measures or account suspensions do not remove rights relating to orders already paid for.

12. Personal data

Personal data processing is described in our Privacy Policy. Accepting the terms of sale does not constitute consent to newsletters, personalised advertising or optional cookies.

13. Liability, complaints and applicable law

Nothing in these terms excludes liability for wilful misconduct or gross negligence, rights under the statutory guarantee of conformity, mandatory product liability or any other rights that cannot be limited by contract. For enquiries or complaints, contact us using the details above, describing the issue and providing the order number where available.

Italian law applies. If you are a consumer, mandatory protections and the applicable rules on court jurisdiction remain unaffected, including those of your country of habitual residence where provided by law. Consumers are not required to submit to an exclusive court other than one recognised by law.

14. Updates

Changes to these terms are published with their date. Orders already concluded remain subject to the version accepted at the time of purchase. If any provision is invalid, this does not affect the remaining valid provisions or the customer's mandatory legal protections.
